Dissolution of marriage in the civil registry offices upon application of one of the spouses in accordance with Article 43 of the Family Code

If one of the spouses:

Is recognized by a court as missing;

Recognized by a court as incapable of acting due to mental disorder (mental illness or mental retardation) ;

in the case of imprisonment for a crime committed for a period of at least three years, regardless of whether the spouses have minor children, at the request of one of the spouses, they are subject to dissolution of marriage in the civil registry offices.

If there is a dispute about the children, about the division of the joint common property of the spouses or about the payment of monetary funds for the maintenance of a needy, disabled spouse (spouse), they are separated from the marriage in a judicial procedure.

• Marriage is registered by the civil registry office at the place of residence of one of the persons to be married, one month after the date of the application of the persons wishing to marry.

• In special exceptional cases (if the parents and the young people to be married live in different regions of Uzbekistan or abroad), at the request of the persons to be married and on the written application of the father or mother, the marriage may be registered in the civil registry office at the place of residence of the parents or one of them.

Procedure for changing the surname, first name and patronymic.

Civil Code art. 19 par. 3. A citizen has the right to change his name in the manner prescribed by law. The change of a citizen's name shall not be grounds for the termination or modification of the rights and obligations that he or she acquired under the former name.

Family Code article 226. Applications for a change of surname, first name and patronymic shall be considered by the civil registry office at the applicant's place of residence after the applicant has reached the age of sixteen.

An opinion on a change of surname, first name or patronymic may be drawn up by the internal affairs authorities only after a proper check has been made by that person.

A refusal by a civil registry body to change a person's surname, first name or patronymic may be appealed in court.

Article 27, part one, paragraph 4, of the Code of Administrative Procedure states: “against a refusal to perform a notarial act or to register a civil registry record or against a dispute over the acts (or omissions) of a notary or an official of a civil registry office;”. The amount of payment is 1 BCV

Paragraph 160 of the “rules for the registration of civil status acts” approved by Cabinet of Ministers Decision No. 387 of November 14, 2016: an application for a change of surname, first name and patronymic is considered by the civil registry office at the applicant's place of residence when the applicant reaches the age of 16.

If a person who has reached the age of 16 submits an application for a change of surname, name, patronymic before receiving a passport or other identity document replacing a passport, a birth certificate shall be attached to the application.

The surname, first name and patronymic may be changed in the following cases:

In accordance with article 15 of the State Language Act;

On the basis of a court decision;

If the surname and first name are unpleasant to the ear;

If the surname and first name do not coincide in terms of nationality;

When returning to a pre-marital surname, depending on the wish (both during marriage and after the dissolution of marriage);

When there is a desire to be on a common surname for the family (if the spouses did not adopt a common surname at the time of marriage);

It is taken into account when establishing paternity to a person who has reached the age of 16 years.

To the application for a change of surname, first name, patronymic shall be attached:

1. the applicant's birth certificate;

2. if the applicant is married, a certificate of marriage, if the marriage is dissolved - a certificate of dissolution of marriage;

3. if the applicant has minor children, the birth certificates of their children;

4. an extract from the applicant's passport or other identity document;

5. if the applicant is recognized as a minor or incapacitated by a court decision, a statement from a parent or guardian or custodian;

6. 1 piece (3x4 size) photo.

In case of loss of the records of the act necessary for making changes, the change of surname, first name, patronymic shall be made after recovery of these documents.
