Advantages of converting to foreign currency

- In order to strengthen the republican currency balance in Uzbekistan, restrictions were introduced on the conversion of monetary funds in amounts into foreign currency within a certain period of time. Investor's income received on the territory of the Republic of Uzbekistan may be reinvested on the territory of the Republic of Uzbekistan or used for other purposes, depending on the wishes of the foreign investor.

Foreign investors are guaranteed free transfer of funds to the Republic of Uzbekistan in foreign currency and their use without any restrictions, subject to payment of taxes or other mandatory payments in accordance with the procedure established by the legislation of the Republic of Uzbekistan.

The Constitutional Court of the Republic of Uzbekistan decided to comment on Article 10 of the Law “On Guarantees and Measures to Protect the Rights of Foreign Investors:

- In favor of resolving economic disputes of the Republic of Uzbekistan within the framework of the law, recognizing the priority of the Constitution and laws, as well as generally recognized norms of international law.

The first section of the law is presented in article 10 “if the parties cannot reach an agreed solution, the dispute shall be resolved in accordance with the rules and procedures of international agreements (agreements, conventions) on the resolution of investment benefits added by the Republic of Uzbekistan” or in the arbitration court of the Republic of Uzbekistan “its use is the rule.

Usually, the agreement of the parties to a dispute to hold it for consideration before a specific body that resolves the dispute is dictated by an additional arbitration to the investment agreement in the form of a note or a separate agreement concluded between the parties to the dispute.

Thus, the decision of the Constitutional Court should not be regarded as discrimination against the rights of foreign investors, and the issue should be approached constructively and within the framework of generally accepted norms of international law, respecting the rights and obligations of each party.

According to Cabinet Resolution No. 654 of October 21, 2021, each family member is recognized as incapacitated if the total average monthly income does not exceed the minimum amount of consumer expenses.

The right of persons with disabilities to education.

Accepted Answer

Persons with disabilities have the right to education in educational organizations and throughout life for the fullest development of their abilities and participation in the life of society and the state.

The state guarantees the development of inclusive education for persons with disabilities, the creation of conditions for education, vocational training, retraining and advanced training.

Pre-school, out-of-school and general secondary education for children with disabilities, as well as specialized secondary, vocational, higher and postgraduate education, are provided.

If it is temporarily impossible to educate children with disabilities in educational institutions, home-based education is provided for children with disabilities on the basis of recommendations by specialized doctors and with the consent of parents or other legal representatives. Education is provided at the expense of the State budget.

Special teaching aids, literature and the possibility of using sign language interpreters are provided at the expense of the State budget.

The education, vocational training, retraining and further training of persons with disabilities are provided in various forms, including on-the-job and off-the-job training, in the form of externships, as well as through the use of distance education technologies, by means of instruction in educational institutions and organizations, specialized educational institutions, at home, in special groups, classes and according to individual curricula.

Uzbekistan recognizes sign language as a means of interpersonal communication for persons with disabilities.

What is the procedure for providing rent subsidies to socially vulnerable families?

Cabinet of Ministers Decision No. 312 of 7.06.2022, in accordance with paragraph 68 of the Regulation “on the order of systematic solution of youth problems and their social support by keeping” the youth book “, approved by the Government Decision ‘On the order of keeping’ the youth book ” and the scheme in Annex No. 17 to this Regulation:

▪️ A young family in which the husband (or wife) is included in the “iron book” ;

▪️ Married child of a woman, included in the “women's notebook” young citizen;

▪️ A young family in which the husband (or wife) is included in the “Unified Register of Social Protection;

▪️ Young family in need of social protection

Compensation for rent for up to 12 months monthly in the amount of not more than

3 times the amount of BCV is subsidized according to the scheme in Annex 17.

The youth leader in the neighborhood examines whether he/she is actually living in rented housing at least once a month based on monitoring.

️ If the study finds that the tenant is not living in rented housing, the rental subsidy will be terminated.

Requirements for foreign investors (enterprises with foreign investment) to receive additional benefits:

- The investment agreement is concluded by the Government of the Republic of Uzbekistan in a mandatory manner to provide a foreign investor with additional (benefits and preferences) to the guarantees and protective measures established by law.

Investment agreement is concluded between the Government of the Republic of Uzbekistan and foreign investor(s) represented by the Ministry of Investment and Foreign Trade of the Republic of Uzbekistan.

To prepare an investment agreement, a foreign investor shall submit the following documents to the Ministry of Investments and Foreign Trade of the Republic of Uzbekistan:

* draft investment contract;

- Basic economic indicators, made on the basis of technical and economic evidence (technical and economic calculation), which have been examined by state bodies in cases established by the legislation;

- Conclusion of the Ministry of Justice - in the field of legal expertise of the draft investment agreement;

* Conclusions of the Ministry of Finance, the Ministry of Economy and the State Tax Committee in the field of granting tax benefits and preferences to foreign investors (enterprises with foreign investments) in addition to the guarantees and protective measures established by law.

The foreign investor submits reports on the fulfillment of obligations imposed on the Ministry of Investments and Foreign Trade of the Republic of Uzbekistan in the manner and timeframe established by the investment agreement.
